The Ministry of Human Resources and Emiratisation (MoHRE) made an announcement today about a new law that aims to regulate employment contracts, specifically for domestic helpers. It looks into their rights, employers’ rights, duties of recruitment agencies, dispute settlements, care and safety, and contracting
The new laws on domestic helpers will come into effect on December 15, 2022
Here is what the new law stated:
Recruiting domestic helpers from outside of the UAE will be allowed only if they are clearly informed about the nature of their work and wages, and if they are able to present evidence of their fitness and professional competence for the job.
The new law also states that recruitment offices, whether directly or through third parties, are prohibited from accepting a commission or incurring any expenses from domestic helpers.
Recruitment agents must also ensure domestic helpers are treated in a humane way and provided with a booklet with details of their wages, in line with the guidelines set by the MOHRE.
They must also ensure that the domestic workers are treated fairly, not exposed to violence and educated about which authorities to contact if their rights are violated.
In the event that the domestic worker is returning to their home country, the agent must cover their travel costs and either provide a substitute helper or refund the amount paid by the employer.
The ministry stated that it’s keen to “regulate the recruitment and employment of domestic helpers in line with international best practices” and aims to “reduce labour disputes and enhance the UAE’s competitiveness”.
